1. Acceptance of terms

By accessing or using BarTab, you agree to these Terms of Service. If you don't agree to them, please don't use the app.

2. Eligibility

BarTab involves reporting and viewing alcohol prices. You must meet the legal drinking age in your country to create an account, and by using BarTab you confirm that you do.

3. Crowdsourced data disclaimer

Prices, menus, operating hours, and venue details on BarTab are user-generated and provided for informational purposes only. We don't independently verify each report, we don't guarantee accuracy, and venues are under no obligation to honor a price shown in the app. Always confirm with the bar before ordering if the price matters to you.

4. User content and licensing

When you submit pricing reports, venue feedback, or menu items, you retain ownership of that content. You grant BarTab a non-exclusive, worldwide, royalty-free license to use, display, modify, and distribute it across the platform for example, showing your price report to other users or aggregating it into a venue's average.

5. Acceptable conduct

You agree not to submit fraudulent prices, spam venues, scrape app data, impersonate a venue, or otherwise misuse the platform. We reserve the right to remove content, and to suspend or terminate accounts, that violate these terms.

6. Venue disputes

If you run a venue and believe a listing is inaccurate, incomplete, or shouldn't be on BarTab, contact us and we'll review it. We handle these case by case rather than removing reports automatically on request, since the platform's value depends on prices staying user-reported rather than venue-curated.

7. Termination

You can stop using BarTab and delete your account at any time from the app. We may suspend or terminate access for accounts that violate these terms, with or without notice depending on the severity of the violation.

8. Disclaimer of warranties

BarTab is provided "as is," without warranties of any kind, express or implied. We don't guarantee the app will be uninterrupted, error-free, or that any price or venue information is accurate or current.

9. Limitation of liability

To the maximum extent permitted by applicable law, BarTab won't be liable for indirect, incidental, or consequential damages arising from your reliance on information published on the service including, without limitation, ordering a drink based on a price that turned out to be wrong.

10. Changes to these terms

We may update these terms from time to time. If a change is material, we'll update the date above and give notice in the app before it takes effect. Continuing to use BarTab after a change takes effect means you accept the updated terms.

11. Governing law

These terms are governed by the laws of Switzerland, without regard to its conflict of law principles. Any dispute not resolved informally will be subject to the exclusive jurisdiction of the courts of Zürich, Switzerland.

12. Apple & the App Store

These terms are between you and BarTab, not Apple. Apple isn't responsible for BarTab, its content, or the prices and venue information in it. Your license to use BarTab is limited to a non-transferable right to use it on Apple-branded products you own or control, as permitted by Apple's App Store Usage Rules.

Apple has no obligation to provide maintenance or support for BarTab. To the maximum extent permitted by law, Apple has no warranty obligation whatsoever with respect to BarTab, and any claims, losses, liabilities, damages, costs, or expenses attributable to the app are our responsibility, not Apple's. We not Apple are responsible for addressing any claims about the app or your use of it, including product-liability claims, claims that the app fails to meet any legal or regulatory requirement, and claims arising under consumer-protection or similar legislation.

In the event of any third-party claim that BarTab or your use of it infringes that third party's intellectual property rights, we not Apple are solely responsible for investigating, defending, settling, and discharging that claim. Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, may enforce them against you as a third-party beneficiary.

For the Apple-provided portions of the App Store, Apple's own end-user license agreement and Terms of Service continue to apply, including the Usage Rules.
